Andrew Pallant and Whoz a Dog Revenge Website
The Herald Sun has declared a war on website developer Andrew Pallant, whose Doglist site seeks to allow people to vent their feelings on other people they don't like. The Herald Sun say that the site is used to bully people, particularly young girls.
This is the Herald Sun's lead into the story "The grub behind a vicious website used by cowards to harass Victorian teenage girls has dared authorities to take action. Melton website designer Andrew Pallant claims his site, which has more than 1300 posts containing unsubstantiated and often vulgar allegations, is designed to protect freedom of speech."
But the whoz a dog website was already covered by Jonathon Creek on Today Tonight last year. This isn't recent news. Already Pallant has had legal action initiated by the President of the Queensland ALP against the doglist site. Its hard to know how far this could go.
The site is hosted in the United States, which should protect it under the 1st amendment's freedom of speech provisions. If it was hosted in Australia a website such as this might have a problem. But the Americans are very protective of their free speech rights.
And of course, given that Pallant isnt writing comments himself, who has the liability? Pallant or the commenter? Probably the latter - and tracking them down would be almost impossible.
As far as i can see, the only problem with this website is that is an outlet specifically designed to allow criticism of other individuals. Given the amount of facebook, myspace, bebo, twitter and other blogs which provide the same opportunity, albeit in an ad hoc way, im not sure how this can be stopped. You would have to shut down all social network sites and blogs to curb personal attacks.
As an example, take the criticism of Gretel Killeen at the Logies on Twitter, or the online stoush between Hughesy and Kyle Sandilands. That's just the high profile stuff, with average Australians engaging in this behaviour every single day. Most blogs or social networking sites allow people to slag off others - this is just one central place to do it.
This is the lead in to Andrew Pallant's website, where he calls for people to voice their opinions on others.

I'm an 18 year old girl, and I find this site hilarious, not because of the content, that of course is disgusting, what I find funny is the fact that all these socially illiterate teenagers have gone to the length of having one giant "I'm a sook and can't handle rejection website". That site is not protected under the First Amendment Right to free speech! The "Miller test" excludes obscenity from protection under the First Amendment. Hate speeches and "fighting words" are excluded from protection under the First Amendment, as are lies (slander). This has been tested (and proven) in the Court.
That is just your legal opinion. The First Amendment could still protect this site. If the Miller Test were applied to all social networking sites, blogs and any site which allows comments they could all be shut down. I would argue that the test should apply to the individual comments not the entire website.
Andrew is a boofhead. He doesn't have a clue about his own legal rights and boundaries in the internet. The latest article about him defending his website rights to publish only reflects his ignorance about the issue. Hi Andrew check out the case of one of the wealthest men in Victoria. His court case against the American-based Dow Jones. He won and Dow Jones paid him millions of dollars for defamatory regardless of the fact that the article was published in USA.

The DDoS idea sounds promising, but I don't have a botnet at my disposal. What we need to do is somehow convince the Ukrainian Mafia that Mr Pallant is leading a campaign against their latest bank fraud spam, then sit back and watch the fireworks.
It's okay for sites like this if it actually provides freedom of speech for a real purpose not just some place to slag off at some girl who pinched your boyfriend or the other crap people write, its just an invasion of privacy for faceless cowards to use,to get at people they don't like. hang about the forum is clearly a vent area as it states clearly, although posting pics and numbers should be banned I agree.Bullying is just ugly and shows insecurity from the abuser more so than the reciever which should be addressed either legally or by counselling before it gets out of hand and in saying that isnt the press and andrew abusers doing just that? Andrew is accountable for his forum in the sense that he should ban users who overstep limits but his forum, aside from a few childish comments, does cover freedom of speech. Most Australians are too damn scared to say how they feel about sensitive issues for fear of racism or criminal implications yet the press and public get to speak freely on these issues hence below and on his forum etc. It is possible his family and himself may live in fear for being so bold so I can only hope he gets himself a good lawyer and counter sues all the offenders, abusers and press who sling off at him due to a passionate hate path. Andrew Pallant does post comments on the website. He and his brothers post most of the stuff to cause others to post. It is a Google click site. For every post he makes $1.00.
He throws it out there, then irate people comment back, voila he gets money.
Most of the comments are directed to people in Frankston, Colac area and western suburbs. His brother lives in Colac, another lives in Frankston and we all know he lives in Melton West, not Melton. I personally know this jerk and I'm telling you exactly how it is.
Well I guess herald sun you should print that. Nobody put anything on his website, and at least then he will get hit in the hip pocket as well as known that the Australian public do not like him and will not support him. I bet we are already paying for him in the way of centrelink benefits! I am a young female who has had my details posted on this site, speaking from personal experience that has only happened within the last week, i find it so disguisting that a site such as this is allowed to run.
Not only was slanderous, disguisting and untreu remarks made about me by someone who obviously feels the need to victimise others, My hometown, personal number, photo and other personal information was aired on the website, I fought for days to have it removed...in the mean time i have had 100's of abusive, disguisting, vulgar text msgs, voice mail msgs and phone calls to me...people contacting my business making threats and many other things happening to me...so the previous comment by one empathetic person who asked the question, how would you feel if it were you or your daughter having htis happen...would you laugh it off..would you congratulate the gutless creator of this site that some low lifes are doing.
I am the first person to welcome freedom of speech and admit that I am an avid user of fb and other socialising networking tools, but never have i used them as a means to bully, and defame another human being.
Bullying comes in all forms, whetehr it be someone physically or emotionally hurting you...this new wave of bullying is somehting that is quickly getting out of hand and something I dont think people really understand how much harm it can do to others.

The content on this website is absolutely disgusting! I believe that if you're so miserable and are being cyber bullied for whatever reason DON'T USE FACEBOOK, MYSPACE, MSN AND DEFINITELY A MOBILE PHONE! This way it obviously makes it easier for people to contact you and send rude messages, threatening emails and photos. That way you won't see what other people write about you and will not be vulnerable.
I am a 16 year old girl and have lived without Facebook, Myspace, MSN and a mobile phone my whole life. I do not intend to ever get these so called necessities as they have no value whatsoever. What is the point of going to school and talking to your friends and then going home, ignoring ANY homework you are supposed to be doing and talking to your friends AGAIN! on the internet. I know I have gone completely off the topic but I need to say this! I've been bottling it up for YEARS! I've tried to tell my friends that Facebook and texting is so unnecessary but they never listen to me. Even telling them about my bullying days wasn't enough. I was bullied via Facebook and spoken about on the internet when I didn't even have Facebook AND I was overseas at the time.
